And Obey Allah And His Messenger, And Do Not Dispute, Otherwise...

The Kavkaz Center publishes an English transcript of an audio statement by the Supreme Judge of the Caucasus Emirate, governor of Dagestan province, Emir of the Dagestani Front of Armed Forces of the CE, Seyfullah.

Praise be to Allah, the Lord of the Worlds, peace and blessings upon the Emir of Mujahideen Messenger of Allah, his family, his companions, and all those who followed the straight path, until Judgment Day.
And then:
Allah says in the Koran:
"O you who have believed, obey Allah and obey the Messenger and those in authority among you".
(The Holy Quran, Surah 4. "The Women", verse 59)
This verse indicates that Muslims must have an Emir and that obedience to Emir is a fard (obligatory) for every Muslim, the same as obedience to Allah and His Messenger.
After the video clip (which was leaked online on 12/08/2010.) about the revoke of the Bayat by commanders of Nokhchicho province, without waiting for other evidence for the revoke, like last time, the situation is rapidly unfolding in a rather bad direction (as the state secrets cannot be made public, once you made them public). If the video clip is authentic, then I make the following appeal:
1. I appeal to Muslims of the Caucasus: brothers and sisters, we should not draw hasty conclusions, condemn or accuse anyone among the Mujahedeen, especially the rulers or Emirs. Because err are humans. Be patient, because such situations occurred during the time of Sahaba. We assure you that , Insha'Allah, we will resolve this issue soon, guided by the Koran and the Sunnah. Make Dua that Allah helps us to get out of this fitna or discord.
2. I address personally to the honorable commanders Aslambek, Hussein, Muhannad and Tarkhan. All the accusations that you are bringing against the Emir of the Caucasus Emirate Dokku Abu Usman, even if you are right in them, do not give you the right, according to the Koran and the Sunnah, to breach the bayat or oath given to the Emir. When you were making the decision to halt the subordination to Emir Abu Usman, what Dalil from the Koran and the Sunnah did you refer to, what scholar gave you this fatwa? And who is your Qadi, or Supreme Judge, for Nokhchicho province? If our brother Muhannad influenced you, then I would say the following: Allah and the faithful are witnesses that I urge you, led by Muhannad, to resolve your dispute using the Koran and the Sunnah.
"And if you disagree over anything, refer it to Allah and the Messenger, if you should believe in Allah and the Last Day".

In commentaries of this verse, Ibn Kathir said:

"If one believer call upon another believer, to solve their dispute by Koran and Sunnah, and he refuses, then he is not a believer in Allah and the Last Day".
And so I begin:
The Messenger of Allah (pbuh) said:

"He who obeys me, obeys Allah, and he who disobeys me, disobeys Allah. He who obeys the Ruler, obeys me, and he who disobeys the Ruler, disobeys me. The Ruler is like a shelter for whose safety the Muslims should fight and where they should seek protection. If the Ruler orders people with righteousness and rules justly, then he will be rewarded for that, and if he does the opposite, he will be responsible for that".
Hudhaifa bin al-Yaman (may Allah be please with him) narrated a hadith in which the Prophet (pbuh) said:
"There will be after me leaders who do not follow my guidance and do not follow my Sunnah, and there will be among them men whose hearts are like those of satan in the body of a human being". And Hudhaifa asked the Prophet (pbuh), 'What we should do at that time if we reach it?' He said, 'listen and obey the ruler, even if he lashed your back and took your money".

Auf bin Malik (may Allah be pleased with him) narrated that the Messenger of Allah (pbuh) said:
"The best of your rulers are those whom you love and who love you, who invoke Allah's blessings upon you and you invoke His blessings upon them. And the worst of your rulers are those whom you hate and who hate you and whom you curse and who curse you. It was asked (by those present): Shouldn't we overthrow them with the help of the sword? He said: No, as long as they establish prayer among you".

The Messenger of Allah (pbuh) said:
"'Verily, after I am gone there will be misappropriation and matters of which you disapprove'. They said, 'O Messenger of Allah, what do you command us to do?' He said, 'To fulfill the rights you owe to others and to ask Allah for what is owed to you'."
(Al-Bukhari, Imam Muslim)
Ibn Umar reported that the Prophet (pbuh) said:
"A Muslim man must hear and obey both in respect of what he likes and dislikes, unless he is commanded to do a wrong action. If he is commanded to do a wrong action, he should not hear or obey".
(Al-Bukhari, Imam Muslim)
Ibn Umar reported that the Prophet (pbuh) said:
"Anyone who removes his hand from obedience will meet Allah on the Day of Rising with no proof. Anyone who dies without having given the oath of allegiance will die the death of the Jahiliyya".

In another version it was reported that the Prophet (pbuh) said:

"... and whoever dies split off from the Muslims will die the death of Jahiliyya!"

Ibn Abbas reported that the Messenger of Allah (pbuh) said:
"Anyone who dislikes something from his Emir should be patient. Anyone who abandons obedience to the Emir for even a short time dies the death of the Jahiliyya".

The Messenger of Allah (pbuh) said:
"Hear and obey, even if an Abyssinian slave with a head like a raisin is appointed over you".
Abu Huraira reported that the Messenger of Allah (pbuh) said:
"You must hear and obey both in your hardship and your ease and with regard to what pleases you and what you dislike and even if you do not get your due".

The Messenger of Allah (pbuh) said:
"Hear and obey, for they will bear responsibility for that entrusted to them, and you for that entrusted to you".

The basis of Sharia (aqidah, creed of Ahl Sunnah Wal Jamaa) is to obey the Emir, even if he is a sinner (fajir) with big sins, if he orders a good deed. But if he orders a forbidden, we do not obey him, but we do not rouse against him (it is written in the books of Ash-Shafi'i, Ahmad, At-Tahawi, Ibn Taymiyyah), when there is no clear a kufr or an infidelity coming from him, as the sun is coming in broad daylight, a kufr, which is testified as such by the unanimity of scholars. If there is no such kufr, then those who went against the Sharia ruler are Kharijites. The same way, as Ahl Sunnah is convinced, it is necessary to wage the Jihad till the Day of Judgment, whenever the ruler is noble or wicked (fasik).
If subordinates do not agree with the Emir in an opinion or decision, then they can give him an advice. But it is not allowed for them to discredit his name, to diminish their respect to him, or to assemble against him and try to remove him from office.
The Messenger of Allah (pbuh) said:
"Whoever demeans the ruler, Allah will humiliate him".


"A good hadith". Because such deeds the Emir of influence, and weaken Muslims. And also, the Emir becomes useless for the management of their affairs. As a result, external enemies become more resolute in the war against Muslims.
Allah said:
"Obey Allah and His Messenger, and do not dispute and [thus] lose courage and [then] your strength would depart; and be patient. Indeed, Allah is with the patient".
(The Holy Quran, Surah 8. "The Spoils Of War", verse 46)
Emir is the same man as we are, acts fairly and makes mistakes, and when he makes mistakes, we should give him guidance and advice, and not halt subornation to him and re-elect another one, finding various reasons in him to removes him from power.
The Messenger of Allah (pbuh) said:
"I swear by Allah, we do not assign the authority of ruling to those who ask for it, nor to those who are keen to have it".
(al-Bukhari and Imam Muslim)
"O Abd ar-Rahman ibn Samurah, do not ask for the position of an Emir, for if you are given it after asking you will be left to discharge it yourself, but if you are given it without asking you will be helped to discharge it".
(al-Bukhari and Imam Muslim)
Fear Allah, brothers, and not make happy infidels, do not be weak, do not let Satan and your pride prevail over you. Do not flatter yourselves that you are in Jihad for many years already. Verily, Allah does need neither us nor our Jihad.
"And whoever strives only strives for [the benefit of] himself. Indeed, Allah is free from need of the worlds".
(The Holy Quran, Surah 29. "The Spider", verse 6)
And therefore, everyone is equal before the Sharia.
The Prophet (pbuh) said:
"Anyone died abandoning obedience to the Emir dies the death of the Jahiliyya".

Some scholars said if the Emir is not a Caliph, there is no obligation for every Muslim to pledge allegiance to him. But, with regard to the Mujahideen, everybody must obey one single Emir. Regarding breach, without reason acceptable by Sharia, of a Bayat already given, it is a haram and angers Allah, according to an unanimous opinion of all the scholars.
If you do not agree with this, show at least one scholar who allows this, his Delil and the book. Otherwise, you make a mistake in your decision to revoke the Bayat (because we can't think that you, the Mujahideen, can follow your passions).
The Prophet (pbuh) said:
"All sons of Adam make mistakes. The best among them are those who do wrong and repent".
Repent to Allah, and resume publicly your Bayat, because you breached it publicly. 
Verily, Allah says:
"And hold firmly to the rope of Allah all together and do not become divided. And remember the favor of Allah upon you - when you were enemies and He brought your hearts together and you became, by His favor, brothers. And you were on the edge of a pit of the Fire, and He saved you from it. Thus does Allah make clear to you His verses that you may be guided".
(The Holy Quran, Surah 3. "The Family Of 'Imran", verse 103)
If you do not do that, then your hukm is Hukm of Bughat (considered as rebels). By Sharia, bughats are not killed or attacked unless they do not interfere, but scholars call them to the Koran and the Sunnah. So behaved with bughats the Emir-ul-Mumineen Ali ibn Abu Talib (may Allah be please with him).
And if someone tries to overthrow a legitimate government of Emir or attempts to spread fitna among Muslims towards their Emir or makes conspiracies, then there's a need to get rid of such a man, and his hukm is Hukm of Khawarij. Based on the words of Allah's Messenger (pbuh):
"He who swears allegiance to a ruler should give him the pledge of his hand and the sincerity of his heart (i.e. submit to him), he should obey him to the best of his capacity. If another man comes forward, disputing his authority, they (the Muslims) should behead the latter".

"If someone comes to you while your case is united around one person, and he wishes to split you and divide your group, then behead him!"
(Imam Muslim) 
Imam Nawawi said:
"In this hadith the command to kill the one who came out against a ruler and wishes to divide Muslims, and if he after caution does not stop, it is necessary to kill him".
And it is only after leading them to a Huji (argument from the Koran and the Sunnah).
I once again appeal to you, Aslambek, since I know you in absentia, because in winter 2003/2004, I was in Endireysk woods with Emir Dadav when you were the Emir of Ichshhoi-Yurt. On the other side of the border of Chechnya, you are known as a good Muslim adhering to the Koran and the Sunnah. To resume your Bayat, put religion of Allah in the first place, remove all personal grievances to the second, and, doing so, you'll be the cause for unity and victory and not for split and strife.
Allah and the believers are witnesses that I conveyed my message to you!
And if, after all this, you stand on your ground, then I now urgently call the distinguished brother Muhannad to appear before the Supreme Court of the Caucasus Emirate, where the Majlis of Scholars will be held. I do not want to make public all (to call it mildly) violations of Muhannad.
And if the Emir of the Caucasus Emirate Dokku Abu Usman decides to hold a trial in another place, I am ready to come to any place in the Caucasus Emirate.
Tell the Truth, no matter how bitter it is.
